terms of service

1. 1To hold an account you must be 16 years old or more.
2. 2You are responsible for the security of your password and for all activity under your account. We cannot restore an account if the password is lost and the email address is absent or incorrect. Add an email address if you want a method to get back in.
3. 3You are responsible for what you put on Backshelf.
4. 4You must be a person. An account made by a bot or by an automated method is not permitted.
5. 5You can hold more than one account. You must not use a second account to get around a suspension, or to give other people an incorrect idea of who you are.

When you use Backshelf, you must not:

• Collect or extract data from accounts that are not yours, or copy profiles in large numbers.
• Get around, disable or interfere with a security function of the site, including the limit on sign-in attempts.
• Pretend to be a different person, or give other people an incorrect idea of who you are or who you are connected to.
• Send malware, or anything that collects data about the other people who visit the site.
• Put content on the site that is unlawful, that shows children in a sexual manner, that incites violence, or that threatens, harasses or targets a person.
• Put content on the site that you do not have the rights to, including images and artwork that belong to a different person.
• Put an unnecessary load on the service or on the networks that it uses.
• Use Backshelf in a manner that breaks the law where you are, or where the service operates.

An account that does any of the above can be suspended or removed without notice.

To report an account or its content, send a message to info@norrwyn.com. Include sufficient detail to find it, such as a link or an image of the screen. Your identity is not given to the account that you report.

1. 1What you put on Backshelf stays yours. We claim no ownership of it.
2. 2You give us a limited licence to hold, copy and show your content. This licence applies only to the operation of Backshelf and to showing your content to the people you select. It ends when you delete the content or the account.
3. 3Content is not examined before it shows on the site. We can remove content at our discretion, but we do not have an obligation to do so.
4. 4Game titles, cover images and related data come from other companies and belong to their owners. Backshelf shows them so that you can identify the games on your shelves.
5. 5The code, the design and the name of Backshelf belong to us. Use of the service gives you no rights to them.
6. 6If you think that content on Backshelf infringes your copyright, send a message to info@norrwyn.com. Identify the work and where it shows on the site.

1. 1You can delete your account at any time in your settings. Deletion is immediate and permanent. The privacy policy tells you what is removed and what stays in the backups.
2. 2We can suspend or terminate an account that breaks these terms. Where the conditions permit it, you get the reason and an opportunity to correct the problem first. Where they do not, you get the reason after the event.
3. 3Abuse or threats against a person who operates or uses Backshelf terminate an account immediately.

1. 1Backshelf is supplied as it is and as it is available. There is no guarantee of availability.
2. 2Any part of the service can change, stop temporarily, or stop permanently. If a change would remove your data, you get reasonable notice and a method to export the data first, unless a condition outside our control prevents this.
3. 3If Backshelf closes permanently, account holders get an email first, with a method to export their data.
4. 4Backshelf is free. If a paid option starts later, it will not put data that you already have behind a payment.

Your data is handled as the privacy policy describes, and for no other purpose. That policy is part of these terms.

A new account is public. Any person can read your profile, your shelves and your reviews, with an account or without one, until you change this in your settings.

We take reasonable measures to protect your data. These include encrypted connections, hashed passwords and backups in private storage.

If you find a security fault, send a message to info@norrwyn.com before you tell other people. A report made in good faith will not receive a legal threat.

Backshelf is tested before each release, and it still contains faults. There is no guarantee that it will agree with your expectations, that a reported fault will be corrected, or that a specific feature will be made. The roadmap is not a commitment.

As far as the law permits, we are not liable for indirect, incidental, special or consequential loss, or for lost data, lost profit or lost goodwill, that results from your use of Backshelf or from an inability to use it. Where liability cannot be excluded, it is limited to the amount that you have paid to use Backshelf.

Nothing here excludes liability that the law does not permit us to exclude. This includes liability for death or personal injury caused by negligence, and liability for fraud. If you are a consumer, you keep all the rights that your national law gives you.

The law of Ontario, Canada governs these terms, and its courts have jurisdiction over a dispute that results from them. If you are a consumer in the European Union, this does not remove the protection of the mandatory rules of the country where you live, and you can start proceedings there.

If a part of these terms cannot be enforced, the other parts continue to apply.

These terms change as Backshelf changes. The date at the top of the page gives the last change. If you continue to use Backshelf after a change, the new terms apply. If you do not accept them, you can delete your account.

If we do not enforce a part of these terms on one occasion, we keep the right to enforce it later.
